All these terms will be useful when concluding contracts and signing papers related to the savings-mortgage system for providing military housing. Each serviceman who logs into the system receives a personal registration number as a participant in the savings-mortgage system, and the funds are transferred to his personal account.

Implementation of the savings and mortgage system

The second chapter of the Federal Law is devoted directly to the implementation of the savings-mortgage system, thanks to which military personnel have the opportunity to improve their living conditions. We will focus only on the key points in order to imagine the order of implementation of the system.

The law determines how the implementation of the right to housing by a participant in the system is carried out. For this First, savings are formed, then a targeted housing loan is provided. How savings are formed

  • compare data;

  • provide information to the system participants themselves if they are included in the register or excluded from it;
  • decide whether to pay out funds;
  • explain to participants how the savings-mortgage system works;
  • perform other functions.

Functions of the authorized body

When this system is in effect, federal management of all processes is mandatory, since funds from the budget are used. It is also important to know the functions of the authorized federal body, which include:

  • accounting of all savings;
  • registration of receipt of funds by system participants;
  • holding competitions to select a specialized depository with the subsequent conclusion of an appropriate agreement;
  • holding competitions for the selection of management organizations;
  • preservation of savings of all system participants;
  • issuance of targeted loans with preliminary registration to participants after receiving relevant applications from them;
  • receiving funds from management organizations;
  • informing about all processes of formation, investment, and use of savings;
  • providing reports on the formation and use of savings to the Government of the Russian Federation annually;
  • informing all system participants about the situation on the housing market;
  • carrying out explanatory work with the population;
  • implementation of other functions provided for by law.

It is noteworthy that a public body is provided to control the operation of the savings and mortgage system for military personnel. A separate article of the law deals with the work of the Council. Representatives of federal executive bodies, public organizations, and securities market participants may be members of the Public Council. At the same time, those persons who make decisions on investing savings do not have the right to join the Council.

All members of the Council work for free. The Council has the right to send requests for investment, ask for various reports, contacting the Central Bank of the Russian Federation and the authorized federal body for this purpose.

Participation in the savings and mortgage system for the military

  5. Officers, both those who voluntarily entered service and those called up from the reserve, who entered into the first contract before January 1, 2005.
  6. Military personnel who received military rank after completing training courses for junior officers in the period from January 1, 2005, who served less than three years under a contract. If they received their first officer rank before January 1, 2008, they must confirm their desire to become participants in the system.
  7. If a person entered the service under a contract, and it provided for an officer rank according to the state, which he received on January 1, 2005, he also becomes a participant in the system. When the specified person received the rank of officer before January 1, 2008, his desire to enter the system must be confirmed.
  8. Persons who became officers after being appointed to a military position for which the rank of officer was provided for by the state, and who served under a contract for less than three years, can also, if they wish, become participants in the savings-mortgage system.

Formation of a register of system participants: inclusion and exclusion

It is important to know on what basis they can include participants in the register, which becomes the reason for exclusion from it.

Receiving the first military rank of an officer becomes the reason for inclusion in the register for the following categories:

  • Military personnel who entered service under a contract, where an officer rank was provided in the state. The period is considered to be from January 1, 2008.
  • Persons who graduated from military educational organizations, both higher and professional, and in the period after January 1, 2005, entered into the first contract for military service.
  • Military personnel who have completed junior officer training courses and subsequently received the rank of officer. The period is considered from January 1, 2008.

The following categories of military personnel need to submit a written application with a request to be included in the register of participants:

  • Midshipmen, warrant officers who have served under a contract for three years since January 1, 2005, if the first contract was concluded before the designated period.
  • If a person became an officer in the process of training, and received military education in the period from January 1, 2005 to January 1, 2008.
  • Persons who received military education between January 1, 2005 and before the onset of this period entered into a contract for military service.
  • Petty officers and sailors, sergeants and soldiers.
  • Military personnel who received ranks after appointment to a position where the officer rank is provided for by the state. The period from January 1, 2005 to January 1, 2008 is considered.
  • Persons who received the rank while serving under a contract and entering a position where the officer rank provides for staff. The period from January 1, 2005 to January 1, 2008 is considered.
  • If the military during the same period, from 2005 to 2008, became officers after completing junior officer training courses.

There are other reasons why military personnel are included in the register of participants in the savings-mortgage system.

Some military personnel voluntarily leave the reserves and enter service. If they were not excluded from the register and did not receive payments, they only need to enter into a new service contract to once again receive all the rights of a participant in the system.

If military personnel returned to service from the reserve voluntarily, but before that they received payment and were excluded from the register, the basis for re-inclusion may be a total duration of service of more than 20 years.

If midshipmen and warrant officers entered into their first military contract after January 1, 2005, but managed to serve for more than three years, they also have the right to become participants in the system.

For officers who entered the service voluntarily or called up for service, it is enough to conclude the first contract for military service.

Exclusion from the registry

Those who retire from military service are excluded from the register of system participants. Of course, all persons whom the state has already provided with living quarters cease to be participants.

Using savings in the account

Funds from the personal savings account of a system participant can be used in some cases. The entire amount remains available under certain conditions. This possibility arises if the total period of military service of the person was twenty or more years.

If a military man retires after ten years for health reasons, due to reaching the age limit for service, for health reasons or due to organizational and staffing measures, he also has the right to use savings. In addition, funds are used when a military man is dismissed for health reasons, declared dead or missing.

The amount of savings does not depend on the size of the family

Registration of documents at the bank may take more than one month

Indexation of annual accruals to NIS participants

Payments are made in accordance with the schedule approved when applying for the loan. “The amount paid by the state is approved annually by the Federal Budget Law. The state pays 1/12 of this amount monthly. The bank calculates the payment based on the amount established in the budget,” the interlocutor clarified.

It's easy to lose your apartment

Perhaps the most important risk when buying housing under the military mortgage program is the fact that a military man can easily lose his apartment upon early dismissal from service, even if the dismissal occurred for reasons beyond his control (for example, due to the disbandment of a unit).
Upon dismissal with less than 10 years of service, the NIS participant must return all CZHZ funds previously allocated to him for the purchase of housing from his own pocket, and repay the remaining loan himself. The presence of preferential grounds will not play any role in this case. Moreover, the money must be returned no later than 10 years from the date of dismissal, taking into account interest equal to the refinancing rate.

Otherwise, both the bank and Rosvoenipoteka will demand money in court, and if the military man is unable to repay the debt, they will take away the housing that is double-collateralized. If a serviceman contributed his own funds when purchasing an apartment, no one will return them if the contract is terminated early.

If the serviceman’s service is more than 10 but less than 20 years, then the used savings funds remain with the serviceman, however, the NIS participant pays the rest of the loan independently.


If a military man with more than 10 years of service is dismissed on preferential terms, then he has no financial obligations to the bank - the state will pay off the mortgage. “Good” grounds for dismissal may include reduction in military unit, health problems, or reaching the age limit of 45 years.

Upon dismissal with more than 20 years of service, CZHZ funds are not refundable. True, there is one nuance here, which one of the agency’s interlocutors drew attention to: if at the time of registration of a military mortgage the serviceman had only 10 years left before retirement (until he reaches 20 years of service), and the mortgage is designed for 12 years, then payments from budget fully covered the mortgage, the military man will need to serve two more years beyond his term.

If a military man with 20 years of service has not used NIS funds, he receives the right to use personal savings at his own discretion.

Additional documents from the spouse

In the case of adding their own funds, the spouse of a military member participating in the NIS may be required to provide additional documents, namely a notarized statement stating that the money additionally paid by the military family is not jointly acquired property.

This is due to the fact that during a divorce, an ex-military spouse often manages to achieve the division of an apartment purchased with a military mortgage. Although the official website of Rosvoenipoteka specifically emphasizes that the common property of spouses does not include payments for a special purpose or housing purchased with these payments, the court often issues similar claims.

On behalf of the President of the Russian Federation, in order to realize the rights to own housing with the help of a mortgage for military personnel, in 2005 a savings-mortgage system (NIS) was developed and began its work. For this purpose, the Federal State Institution “Rosvoenipoteka” was created, the main functions of which are:

  • posting on the official website all necessary information for the population;
  • preparation of documents and certificates;
  • maintaining a register of participants;
  • accounting of all savings in accounts;
  • implementation of measures aimed at obtaining funds for military personnel;
  • other functions provided for by law.

All functioning of the savings and mortgage system is regulated by the following regulations:

  1. Federal Law No. 117 “On the NIS of housing provision for military personnel” dated August 20, 2004.
  2. Civil Code of the Russian Federation.
  3. Housing Code of the Russian Federation.
  4. Decree of the Government of Russia No. 655 of November 7, 2005 “On the procedure for functioning of the NIS of housing provision for military personnel.”

The main one, of course, is 117-FZ, which establishes the obligations, rights of the parties involved, features of the targeted expenditure of funds and other restrictions and opportunities.

The essence of the NIS lies in monthly subsidies from the federal budget to the personal accounts of military personnel participating in the system from the very moment of registration/receipt of a confirming certificate. You can use the money accumulated in the account only after 3 years from the date of its opening to pay the down payment on the mortgage or pay off part of the current debt under the loan agreement.

Military mortgage allows NIS participants to buy an apartment or a separate house in both the primary and secondary real estate markets. The acquisition of land for the purpose of further construction under this program is not permitted.

How to register with NIS

In order to become a participant in the NIS, a serviceman must comply with the categories of military personnel entitled to receive a military mortgage established by 117-FZ. These categories include:

  • military personnel with the rank of officer who entered into their first contract for service in the RF Armed Forces after 2005;
  • warrant officers, midshipmen and petty officers with a contract duration of more than 3 years;
  • soldiers, sailors, sergeants with a repeat contract concluded after the start of the state program.

The registration procedure itself in NIS is carried out in two ways:

  • automatically (the register and lists of military participants are formed in educational institutions and upon concluding a contract for service without the participation of the military man himself);
  • using an application (military personnel who do not fall under the requirements of federal legislation can, on their own initiative, submit a report addressed to their immediate superiors with a request to become a member of the NIS and subsequently receive a preferential mortgage).

If the outcome of the case is positive, the applicant will be included in the register and will receive a supporting certificate. After this, Rosvoenipoteka will assign the military man a unique identification number (registration number of a participant in the savings-mortgage system) and open a personal savings account, to which government funds will then be credited.

Participation in NIS and use of savings

The legislation annually establishes the amount of the NIS contribution, which will be transferred to the military personnel to his personal account. The transfer is carried out by dividing this amount into equal 12 parts - that is, for each calendar month. In 2017, the contribution of the savings-mortgage system is 260 thousand rubles. This amount is subject to annual indexation and adjustment taking into account inflation, but since 2016 it has remained unchanged. This is due to the unfavorable economic situation in the country.

After three years of participation in the NIS, when there is already a sufficient amount in the account, the serviceman will be able to use these funds to apply for a targeted housing loan under the preferential “Military Mortgage” program. In summary, the process of implementing the NIS program is as follows:

  1. Choosing housing

Since 2016, military personnel have been given the right to independently choose the property to be purchased, including the district of the city or town, house, number of floors, layout and area. But naturally, there are a lot of restrictions imposed both by Rosvoenipoteka and banks. Housing must be included in the list of facilities accredited by these structural divisions (you can find out more specifically on the websites or in person) and meet the established requirements. Such requirements include the permissible level of wear and tear of the building (for the secondary market), the presence of necessary communications, compliance with all social and sanitary standards according to the Housing Code of the Russian Federation, etc. It will not be possible to buy dilapidated housing subject to demolition or reconstruction, as well as apartments with illegal redevelopment . No one will give such permission.

  1. Studying offers in banks

NIS participants will be able to obtain a mortgage loan only from certain partner banks. Currently, 13 largest Russian banks are implementing such programs, including Sberbank of Russia, Gazprombank, Rosselkhozbank, Svyaz Bank, Zenit Bank and others. The lending conditions in them are quite similar, but there are still some differences. They relate to the interest rate, type of payments, the need for insurance and the requirements for the borrower.   1. Preparation of a package of documents and submission of a loan application

Along with the NIS participant certificate, the military man will have to provide the bank with a minimum set of documents, including a Russian passport, an application form and documents for the purchased property. Some banks may additionally require a marriage certificate, SNILS, consent of the spouse to receive a loan and transfer of housing as collateral. For secondary real estate, it will be necessary to provide a report on a professional assessment of the property (the assessment is carried out at the serviceman’s own expense).

  1. Submitting the submitted application to the Credit Committee and making a final decision

Like any other mortgage application, an application for a military mortgage is considered at least 5-7 days, since a thorough check of the provided documents and real estate, in particular, is required. The maximum duration for making a decision does not exceed 14 working days. After this, the final decision will be immediately announced to the client.

  1. Conclusion of a purchase and sale agreement

If the bank makes a positive decision in favor of the potential borrower, then the next stage will be the conclusion of a tripartite purchase and sale agreement between the buyer (NIS participant), the seller and Rosvoenipoteka. The contract must stipulate in the clause on the procedure for payment for the purchased housing that the transfer of money will take place using borrowed funds.

  1. Conclusion of a mortgage agreement

The mortgage agreement is concluded after agreeing on all details and terms of registration with the bank and Rosvoenipoteka. A payment schedule will be a mandatory annex to the agreement. After signing the contract and schedule, Rosvoenipoteka will transfer the amount of the down payment to the account of the real estate seller. All operations by this body are carried out exclusively in non-cash form, which allows for maximum transparency of all procedures. All terms for receiving money are set out in detail in the mortgage agreement. As soon as the government agency transfers the money to the seller, the remaining amount will be credited by the creditor bank.

  1. Fulfillment of loan obligations by the borrower

The current payment schedule details the terms of repayment of the client's debt, broken down by month. For military personnel who want to take advantage of preferential mortgage terms, it is worth knowing how to obtain a certificate of participation in the NIS (savings and mortgage system). In this article we will write the main steps that a military personnel needs to take to obtain the specified certificate. After all, it is the possession of this certificate that opens the door to obtaining the desired apartment.

Brief theoretical thesis. NIS Certificate– this is a certificate giving its owner (a military serviceman) the right to receive a targeted housing loan from the state. Payment for this loan is carried out by the Federal State Institution “Rosvoenipoteka”, which we will also discuss in the article. If we compare the classic mortgage and the military one, then, in the case of the latter, monthly payments are covered precisely by the savings of the NIS participant and amount to 1/12 of the annual state contribution for this participant. For 2016, the amount of contributions is 245,880 rubles, i.e. The state pays 20,490 rubles a month to pay the mortgage.

It is this that will have to be submitted to the bank along with all other documents for consideration of the mortgage application. The NIS certificate gives its owner the right to obtain a preferential mortgage and pay for it at the expense of public funds.

How to obtain an NIS certificate?

The Ministry of Defense has formed the exact procedure for registering and obtaining this certificate in the form of Order of the Ministry of Defense dated February 28, 2013 No. 166 “On approval of the procedure for implementing the savings-mortgage housing system for military personnel in the RF Armed Forces.” Translated into a language understandable to most, these steps result in the following:

Step 1) First of all, you need to become a participant in this system. Military personnel become participants either voluntarily, by writing a report, or forcibly.

The following categories of military personnel can take voluntary participation in the NIS system:

  • Persons who graduated from military educational institutions of professional education, starting from January 1, 2005, who entered into the first contract for military service before January 1, 2005.
  • Sergeants and foremen, soldiers and sailors who entered into a second contract for military service no earlier than January 1, 2005;
  • Warrant officers and midshipmen whose total duration of military service under the contract will be 3 years, starting from January 1, 2005, if they entered into the first contract for military service before January 1, 2005 (i.e. after January 1, 2002) ;
  • Persons who graduated from military educational institutions of professional education in the period after January 1, 2005 to January 1, 2008, who received the first military rank of officer during the training process.
  • Persons who received the first military rank of officer in connection with entering military service under a contract for a military position for which the state provides for the military rank of officer, starting from January 1, 2005 to January 1, 2008.
  • Military personnel whose total duration of military service under a contract is less than 3 years, who received the first military rank of officer in connection with appointment to a military position for which the state provides for the military rank of officer, in the period after January 1, 2005 and before January 1, 2008.
  • Military personnel whose total duration of military service under a contract is less than 3 years, who received the first military rank of officer in connection with the completion of junior officer training courses in the period after January 1, 2005 and before January 1, 2008.

Compulsory participation in the NIS system is imposed on the following categories of military personnel:

  • Persons who graduated from military educational institutions of vocational education and entered into the first contract for military service after January 1, 2005.
  • Officers called up for military service from the reserves or who voluntarily entered military service from the reserves and who entered into the first contract for military service starting from January 1, 2005.
  • Warrant officers and midshipmen who entered into their first contract for military service after January 1, 2005 (can become participants in the NIS if the total duration of their military service under the contract is 3 years).
  • Persons who received the first military rank of officer in connection with entering military service under a contract for a military position for which the state provides for the military rank of officer, starting from January 1, 2005.
  • Military personnel whose total duration of military service under a contract is less than 3 years, who received the first military rank of officer in connection with appointment to a military position for which the state provides for the military rank of officer, starting from January 1, 2008.
  • Military personnel whose total duration of military service under a contract is less than 3 years, who received the first military rank of officer in connection with the completion of junior officer training courses starting from January 1, 2008.
  • Military personnel participating in the NIS who, after leaving military service, entered into a contract for military service with any federal executive body where federal law provides for military service.

In case of voluntary participation, the serviceman, as already written above, writes a corresponding report addressed to the unit commander. This report must be recorded in the official document register. After review, this report is sent to one of the military departments, where data from other participants is collected. This generalized consolidated list is then sent to the registration body of the Ministry of Defense, where the serviceman is included in the register of participants in the savings-mortgage system. According to the register, each NIS participant is assigned a registration number, which is subsequently linked to a personal savings account where funds are received from the state.

After a serviceman is included in the NIS register, he is sent a notification about his successful registration in the system, and his registration number is also transmitted. The serviceman became a member of the NIS .

Step 2) Having received a notification about inclusion in the NIS register, a serviceman can do nothing for the next 3 years, except honestly carry out his service. Over the next 3 years, funds will be accumulated in his personal savings account, which, of course, he cannot spend. After 3 years of service, a serviceman who wants to improve his living conditions submits another report to receive a NIS participant certificate addressed to the unit commander. This report must also be recorded in the official document log.

  • The official responsible for the implementation of the NIS in the military unit, based on the reports of the NIS participants, generates information in the form according to Appendix No. 14 to the Procedure and sends it to the regional housing department (RUZHO).
  • This department collects and processes information from NIS participants who have expressed a desire to receive a housing loan from the state.
  • Having generated the necessary lists, RUZHO transfers them further along the chain - to the Housing Department of the Ministry of Defense of the Russian Federation, which is essentially the registration authority. He registers the participant in his register and already transfers them to the Federal State Institution “Rosvoenipoteka”, which will continue to be the payer of savings contributions and monthly payments on the mortgage loan.
  • Rosvoenipoteka issues an NIS certificate and transmits it back along the chain to the military personnel either by mail or through an official.

What does the department of the Federal State Institution “Rosvoenipoteka” do:

  • Accumulation of funds for NIS participants;
  • Registration of certificates of NIS participants;
  • Registration of housing loans for military personnel;
  • Transfer of funds to the bank as monthly mortgage payments;
  • Registration and issuance of savings of NIS participants in cash in the event of the right to use them;

After receiving the NIS certificate

Having received the desired certificate, the serviceman can begin to look.
